NetRexx LOGO

We are just starting a Marketing campain, and I would like to make some advertisement FOR NetRexx

    I do remember that Mike did introduce a new LOGO (a net on a blue
background): I personally would like to use that.

I'm releasing ReyC by end of January (2011), and need to have the proper

Re the logo: I see it is the one on the cover TNRL  -- is it legal to use it?  Is it the "official" NetRexx logo?  It also seems easily confused with the similar one on the cover of The Rexx Language.

I´m no lawyer so my replies should not be taken as legal advice. In
short: I don´t know. I always assumed that the drawing of the TNRL
book was the somewhat official NetRexx logo.

All I know is that it has been used before, see

MFC is the one who could give you more precise information about the
official logo and the legal angle.

Btw: on the page above, I couldn´t help noticing "NetRexx is currently
hosted by IBM. RexxLA The Rexx Language Association will soon host it"

The page is dated and "last updated" 1998... depends on how one
defines "soon" right.... ? ;-)

That wouldn't really be it. It's a quick job I made taking the cover image of TNRL as a base.

I didn't seek for use permission from the owner (Prentice Hall?) so I'm pretty sure it wouldn't be appropriate for commercial products promotion materials.

But you didn´t seek permission from the publisher, or did you?. :-) If
lawyers had their way, 50% of the population would be in jail. Just
downloading some jpg from a web site is an unauthorized duplication

I´m not saying he shouldn´t seek permission from the publisher... I
just thought that it was MFC´s official logo and he gave it away for
the community to use, as I saw it on several web pages.

In any case, it´s Thomas´ duty to seek permission, not me, as he´s the
one planning to use a netrexx logo for his commercial purposes...

One of the first duties of the RexxLA btw should be to establish an
official logo and liberal usage guidelines, so web pages can use it to
promote the language...

IANAL, but by does something like this avoid any copyright issues?:

I think there are two images being discussed; one is the 'playing card king' on the cover of my book, and the other is the one used on NetRexx web pages: 

 

The first of this is the copyright of some playing card company -- I recall Prentice-Hall had to play some hefty royalty to use it on Bob O'Hara's book -- but that covered all four kings, so the others were available 'free' for my two Rexx books and then NetRexx.   I imagine those images are still copyright.

The NetRexx logo above was specifically designed for NetRexx by an IBM graphics designer (it is supposed to represent a network, overlaid on a projection of the earth).  It had all the appropriate trademark searches done before we started using it, so it will have cost a significant amount of time & money.  It would be IBM's at this point, although I think anyone would consider it part of the NetRexx IP, so it would automatically transfer to RexxLA when NetRexx does.
